Welcome to Wellness With HLOCare. These Terms of Service (“Terms”) govern your access to and use of our website, services, patient portal, telehealth platform, and related offerings (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. About Wellness With HLOCare

Wellness With HLOCare provides administrative, technology, communication, and care coordination services that connect patients with licensed healthcare providers for medical weight loss evaluation and treatment.

Wellness With HLOCare does not provide emergency medical services.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be physically located in a state where our providers are authorized to provide care
  • Provide accurate and complete information
  • Agree to comply with these Terms

Meeting eligibility requirements does not guarantee treatment, medication approval, or a prescription.

3. Telehealth Services

Healthcare services are provided through telehealth by licensed healthcare providers. Telehealth may include:

  • Medical evaluations
  • Treatment recommendations
  • Prescription management
  • Follow-up assessments
  • Secure messaging

Telehealth may not be appropriate for all medical conditions.

If you are experiencing a medical emergency, call 911 or seek immediate in-person medical attention.

4. No Provider-Patient Relationship Until Accepted

Submitting an intake form, creating an account, completing payment, or communicating with Wellness With HLOCare does not establish a provider-patient relationship.

A provider-patient relationship is established only after a licensed provider reviews your information and agrees to provide care.

5. Prescription Eligibility

Completing an intake form or purchasing a treatment plan does not guarantee approval, treatment, or a prescription.

All treatment decisions are made solely by a licensed healthcare provider based on:

  • Medical history
  • Current medications
  • Safety considerations
  • Clinical judgment
  • Applicable laws and regulations

Providers may decline treatment, request additional information, request laboratory testing, or recommend alternative treatment options.

6. Medical Weight Loss Medications

Wellness With HLOCare may facilitate access to medications including semaglutide, tirzepatide, and other weight management therapies when clinically appropriate.

Individual results vary.

We do not guarantee weight loss, maintenance of weight loss, or any specific health outcome.

Treatment success depends on many factors including medication adherence, nutrition, physical activity, medical conditions, and individual response to treatment.

7. Compounded Medications

Certain medications offered through Wellness With HLOCare may be compounded medications.

Compounded medications:

  • Are prepared by licensed compounding pharmacies
  • Are not reviewed or approved by the U.S. Food and Drug Administration (FDA)
  • Have not been evaluated by the FDA for safety, effectiveness, or quality

Compounded medications are prescribed only when determined appropriate by a licensed healthcare provider.

8. Patient Responsibilities

You agree to:

  • Provide accurate and complete health information
  • Update information when changes occur
  • Follow provider instructions
  • Report side effects or adverse reactions
  • Maintain the confidentiality of your account credentials

You understand that incomplete, inaccurate, or misleading information may affect treatment decisions and patient safety.

9. Follow-Up Care and Refills

Continued treatment may require:

  • Follow-up assessments
  • Updated health information
  • Laboratory testing when clinically indicated
  • Provider review

Medication refills and dose adjustments are not automatic.

Failure to complete required follow-up assessments may delay or prevent refills, dose adjustments, or continuation of treatment.

10. Pricing and Payments

All services are self-pay unless otherwise stated.

By submitting payment information, you authorize Wellness With HLOCare and its payment processors to charge the applicable fees.

Prices are subject to change at any time.

You are responsible for all charges associated with your treatment plan.

11. Refund Policy

Due to the nature of medical services and prescription medications, fees for medical evaluations, provider services, prescriptions, pharmacy processing, and shipped medications are generally non-refundable.

Refund requests will be reviewed on a case-by-case basis in accordance with applicable law.

12. Shipping and Delivery

Medication delivery is handled by licensed pharmacies and third-party shipping carriers.

Delivery timelines are estimates only.

Wellness With HLOCare is not responsible for delays caused by:

  • Pharmacy processing
  • Carrier delays
  • Weather events
  • Supply shortages
  • Regulatory requirements
  • Circumstances beyond our control

13. Privacy

Your use of our Services is also governed by our Privacy Policy and HIPAA Notice of Privacy Practices.

By using our Services, you consent to the collection, use, and disclosure of information as described in those policies.

14. Disclaimer of Warranties

The Services are provided on an “as-is” and “as-available” basis.

To the fullest extent permitted by law, Wellness With HLOCare disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, Wellness With HLOCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Nothing in these Terms limits liability where such limitation is prohibited by law.

16. Changes to Services or Terms

We may modify these Terms or our Services at any time.

Updated Terms will become effective upon posting to our website.

Your continued use of the Services constitutes acceptance of any revised Terms.

These Terms shall be governed by and construed under the laws of the State of Texas without regard to conflict of law principles.
